ALL OTHER PRODUCTS WARRANTY

The product you have purchased is warranted by the manufacturer for one year from the date of original purchase for domestic use against defects in workmanship and/or materials.

 

LIMITATIONS

This limited warranty is in lieu of all other warranties expressed or implied, including warranties of merchantability and fitness for a particular purpose and excludes all liability for incidental or consequential damages for any cause whatsoever.

 

This warranty is not transferable.

 

Warranty will be void in the following situations:

  • Improper product storage

  • Cleaning-related issues

  • minor imperfections that should not affect the product’s structural integrity

  • minor variations in colour

  • When the product has been used under conditions that differ from those for which it was intended

  • When the product has not been assembled or operated according to the user manual provided with it, where applicable

  • When the product has been modified in any way

  • When damage occurred because of an accident, improper handling or operation, shipping, abuse, or misuse.

  • Continued use of the products after a defect has become apparent.

  • Acts of God or force majeure events, including but not limited to war, riot, invasion, act of terrorism, contamination, earthquake, flood, fire, or other natural disaster,

  • or any other event or circumstance beyond our control.

MAXIT GARBAGE CAN WARRANTY

GL proudly warrants that its Maxit commercial-grade products are manufactured to meet high standards of quality and durability. Under regular use and service conditions, these products are guaranteed to be free from defects in materials and workmanship for the period of ten years from the date of original purchase.

If a product or its component is found to be defective under normal use and as intended during the applicable warranty period, GL will, at its discretion, either replace the product or component, repair it, or issue a refund—provided the item is still available for purchase. In the case of a refund, GL will return a pro-rated amount based on the actual purchase price (or the current retail price if the original price is unavailable), calculated using straight-line depreciation at 10% per year. For instance, if the product has been owned for 7 years under a 10-year warranty, the refund amount would be 30% of the original purchase price.

HOW TO FILE A WARRANTY CLAIM?

If you have purchased a product that is unusable or faulty, or you believe it is subject to a defect, cease using the product immediately.

 

Contact us at info@graciousliving.com as soon as you become aware that the product is defective with the following information:

  1. Attach a copy of the original proof of purchase and proof of delivery date if different than the date of purchase

  2. Attach clear, detailed photograph(s) of the missing or damaged part or product

  3. Write a brief description of the problem, specifying the circumstances

  4. State your full name, mailing address, and phone number. We cannot ship to a P.O. box.

 

A GL representative will be in touch with you regarding your warranty claim.


Where your claim is valid, we will, at our own cost:

  • replace the product at our sole discretion; or

  • If we are unable to replace the product, we will offer you a choice of a refund or a comparable product.

 

OTHER WARRANTY LIMITATIONS

GL makes no warranty concerning the merchantability of its product or as to the fitness of the product for a particular use that may be provided by the Uniform Commercial Code or any other comparable statute other than the warranty described herein. GL shall not be liable for incidental, special, consequential or other similar damages arising from the breach of this warranty. In particular, the liability of GL, if any, and the purchaser’s sole remedy for damages for any claim of any kind whatsoever, regardless of legal theory and whether arising in tort or contract, shall not be greater than the actual purchase price of the product with respect to which such claim was made.

 

Some states or provinces do not allow the exclusions or limitation of incidental or consequential damages, so that the limitation to exclusion referring to these in this warranty may not apply. This warranty gives you specific legal rights, and you also have other rights that vary from state to state and from province to province.

 

This warranty shall only be applicable and enforceable in Canada and in the United States of America.

 

Gracious Living

 

This warranty overrides any other warranty information found in product manuals or on product packaging.
